1. Agreement to Terms

By accessing or using this website, scheduling a consultation, enrolling in any program, or engaging with any service offered by Low Tide Lighthouse — a trade name of Saraphina Mare LLC, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use this website or engage with any services offered through it.

Low Tide Lighthouse reserves the right to update these Terms at any time. Continued use of the website or services after any changes constitutes acceptance of the revised Terms.

2. Nature of Services

Low Tide Lighthouse provides education, lived-experience guidance, advocacy navigation, and consultative support for individuals and families navigating foster care, adoption, and kinship care. All services are educational and informational in nature only.

Services provided by Low Tide Lighthouse are NOT: therapy, counseling, psychotherapy, mental health treatment, legal advice, legal representation, financial advice, licensed social work services, medical advice, or any other licensed professional service. HB / Saraphina Mare is not acting in a licensed professional capacity in any of these areas.

Participation in any program or consultation does not create a therapeutic relationship, attorney-client relationship, fiduciary relationship, or any other licensed professional relationship.

National Operation

Services are delivered remotely via video conferencing and are available to clients throughout the United States. Low Tide Lighthouse operates under the laws of the State of Colorado regardless of the client's state of residence. By engaging with Low Tide Lighthouse from any state, you acknowledge that you are voluntarily entering into a consulting relationship governed by Colorado law.

3. Jurisdiction-Specific Acknowledgment

Low Tide Lighthouse serves clients in all 50 states via remote video consultation. You acknowledge and understand that:

  • Foster care and adoption laws, regulations, policies, procedures, and available services vary significantly by state, county, and agency.

  • Information provided is based on general knowledge and lived experience and may not reflect the specific laws or procedures of your state, county, or agency.

  • You are responsible for verifying all information with licensed professionals and authorities in your specific jurisdiction.

  • Low Tide Lighthouse makes no representation that guidance provided applies uniformly across all states.

  • Nothing shared through this service constitutes legal advice under the laws of any state.

4. No Guarantee of Outcomes

Low Tide Lighthouse makes no representations, warranties, or guarantees regarding any specific outcome arising from participation in any program, consultation, or use of information on this website. Results vary based on individual circumstances, state laws, and the actions of third parties including agencies, caseworkers, and courts. No outcome can be promised or guaranteed.

5. Client Responsibility

You acknowledge and agree that:

  • You are solely responsible for all decisions made regarding your licensing process, home study, placements, legal agreements, adoption finalization, and any other foster care or adoption matters.

  • You will seek qualified licensed professional counsel, including attorneys, therapists, medical providers, and social workers in your state, for matters that require it.

  • Information provided by Low Tide Lighthouse does not replace the guidance of your agency, caseworker, adoption attorney, or any other professional in your case.

  • You are responsible for confirming all information with licensed professionals in your jurisdiction before making decisions.

6. Payment Terms

All fees are due in full at the time of booking or enrollment unless a written payment plan has been agreed upon. All fees are charged in US dollars. Prices are subject to change but will not affect programs already booked and paid.

7. Cancellation and Refund Policy

Discovery Calls (Free)

Free discovery calls may be cancelled or rescheduled at any time. Please provide 24 hours notice when possible.

Paid Consultations

Cancellations 48+ hours before a session: full refund or reschedule. Cancellations less than 48 hours: non-refundable but may be rescheduled at discretion of Low Tide Lighthouse. No-shows without notice forfeit the full session fee.

Programs and Packages

Full refund within 7 days of enrollment if no sessions have taken place. Once any session has occurred, no refunds are issued for sessions already delivered. Remaining sessions may be rescheduled but are not refundable. If Low Tide Lighthouse cancels a program, a prorated refund for unused sessions will be issued within 14 business days.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Low Tide Lighthouse and Saraphina Mare LLC shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from:

  • Your use of or inability to use this website or any services

  • Any decisions made based on information provided through consultations, programs, or website content

  • Any outcomes related to foster care placements, adoptions, or licensing processes in any state

  • Any errors, omissions, or inaccuracies in information provided

  • Any actions taken by agencies, caseworkers, courts, or other third parties

  • Any variation in state law or policy that affects the applicability of guidance provided

  • Technical failures or connectivity issues affecting remote video sessions

In no event shall total liability exceed the total amount paid by you for the specific service giving rise to the claim in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Low Tide Lighthouse and Saraphina Mare LLC from any claims, damages, losses, liabilities, costs, and expense, including reasonable attorney fees, arising from your use of services, violation of these Terms, or decisions you make based on information provided through Low Tide Lighthouse.

10. Intellectual Property

All content on this website, including written materials, program content, assessments, guides, handouts, frameworks, graphics, logos, and branding, is the exclusive property of Low Tide Lighthouse and Saraphina Mare LLC. You may not copy, reproduce, distribute, sell, or use any content for commercial purposes without prior written permission. This applies regardless of your state of residence.

11. Confidentiality

Low Tide Lighthouse treats all client information with strict confidentiality. Information shared during consultations will not be disclosed to third parties without your consent, except as required by law or when there is imminent risk of harm. Clients are equally expected to keep confidential any personal information shared by HB/ Saraphina Mare, including stories involving her family and children.

12. Remote Service Delivery

All consultations and program sessions are delivered via video conferencing. You are responsible for ensuring adequate technology, internet connection, and a private space to participate. Low Tide Lighthouse is not responsible for technical issues on the client's end. Missed sessions due to client technical issues are subject to the cancellation policy in Section 7.

13. Testimonials

Testimonials on this website reflect individual client experiences. Results vary significantly based on state laws, agency policies, and individual circumstances. Testimonials do not constitute a promise or guarantee of similar outcomes.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions. By engaging with Low Tide Lighthouse from any state, you waive any claim that the laws of your state of residence should govern this agreement.

Any disputes shall first be addressed through good-faith written negotiation. If resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration in El Paso County, Colorado under the rules of the American Arbitration Association. You waive the right to a jury trial for any claim arising from this agreement.

15. Severability

If any provision of these Terms is found unenforceable, it shall be modified to the minimum extent necessary, and remaining provisions shall continue in full force.

16. Entire Agreement

These Terms, together with any separately signed program service agreements, constitute the entire agreement between you and Low Tide Lighthouse.
